HGS Serves as Lead Counsel for Progress Energy's State Certification of First Nuclear Project in Florida Since 1976

On August 11, 2009, Florida Governor Charlie Crist and the Florida Cabinet, sitting as the state’s Siting Board, voted unanimously to approve Progress Energy Florida's application for certification for the construction and operation of a two-unit 2200 MW nuclear-powered electrical generating facility to be located on a “greenfield” site in Levy County, Florida, along with other associated facilities.  The Siting Board’s action also included approval for nine electrical transmission line corridors, totaling 185 miles in length.  The Siting Board’s approval occurs following a two year review process involving numerous state, regional and local agencies and several public hearings and other opportunities for the public to learn about the project and to provide their input. The project represents a substantial investment in Florida’s economy while contributing to the state’s goals of reducing greenhouse gas emissions. 

Gov. Crist said that the Siting Board’s “decision proves that Florida is on the right path toward achieving energy diversity and independence. A team of HGS energy practice attorneys, led by Doug Roberts, Virginia Dailey and Frank Matthews, served as lead outside counsel to Progress Energy Florida in obtaining this certification from the Siting Board under the Florida Electrical Power Plant Siting Act.   The two new nuclear units are the first approved in Florida since 1976.
