Sometimes these issues cannot be handled informally and must be dealt with under the extensive procedures outlined in the Florida Administrative Procedures Act (APA), the Uniform Rules of Administrative Procedure and the statutes and rules that govern state agencies. The APA assigns the ultimate authority to decide issues of fact and the validity of rules to the Division of Administrative Hearings. Our lawyers regularly represent clients before Administrative Law Judges in trial-type proceedings. In addition, the firm's lawyers are routinely involved in drafting and advocating changes to the APA itself.

Sometimes our clients have issues before an agency which involve agency rulemaking, and our lawyers advocate rules which serve our clients' interests. On the other hand, our lawyers are often called upon to legally oppose new rules which will hamper a client's ability to effectively engage in its business endeavors. In addition, firm lawyers often bring administrative challenges to existing agency rules when they are unfair or unreasonable in their application.

There are also a variety of actions that agencies take which affect the rights and interests of our clients. Agency actions issuing or denying permits, agency development approvals or modifications, or agency decisions imposing regulatory requirements in particular circumstances can result in significant impacts to businesses, developments, and individual projects.  Our firm has years of experience and a track record of success in agency administrative actions and administrative litigation.
