Due Diligence and Regulatory Compliance Counseling

depThe owner of property or operator of a facility subject to local, state, and federal environmental laws, rules, and regulatory programs is assumed to have a policy of full compliance with such requirements as a component of an effective business plan. This same policy would be prudent for any prospective purchaser or seller of property.  Our firm has represented prospective purchasers and sellers, land developers, industrial facility owners and operators, insurance companies, local governmental entities, and lending institutions, all of whom need to know whether the policy of environmental compliance is met, and if not, how and when such policy can be efficiently and economically established and implemented.  Our job is to work separately or in conjunction with other team members such as in-house counsel, environmental managers, or consulting engineers and technicians, to contribute the best advice and service possible on environmental compliance issues.

The cases presented can be simple or complex.  We tailor our representation to fit the circumstances of each case. A straightforward case deserves a concise and efficient opinion. A multi-party, factually complex case may need an innovative strategic approach. Our track record demonstrates an ability to provide representation which addresses each individual case in a way that is appreciated by our clients and which leads to repeat work or appropriate referrals to others in need of similar help.

As Florida becomes subject to increasing development pressures, more properties and facilities are required to undergo due diligence and regulatory compliance evaluations.  These evaluations must be conducted under a multi-media multi-disciplinary approach, applying complex local, state, and federal laws.  Our firm has extensive experience in assisting clients with all appropriate inquiries necessary to ensure that environmental policies are properly established and maintained.  In addition, we provide transactional advice to our clients on matters of environmental risk transfer, environmental insurance, and regulatory compliance so as to protect them against liabilities associated with environmental conditions on properties and at facilities.
